AVANTAGES SOCIAUX/FRINGE BENEFITS

Régime d’assurances collectives/Group insurance plan

The employer’s contribution to the insurance plan is currently minimal compared with the contributions made by employers in most private schools and within the public education system.

Do you agree that the employer should increase its contribution to the plan to reduce its cost?

Droits parentaux/Parental rights

The collective agreement establishes different provisions depending on the level of experience of the employee. Employees with less than six months of continuous service are entitled only to the minimum protections provided by legislation. In contrast, employees with at least six months of service benefit from a broader range of contractual rights and benefits, including benefits payable during certain parental leaves. When compared with the provisions available in the public sector, this distinction appears inequitable.

Do you wish to reduce this period to receive the full benefits more quickly?

Congé autorisé sans traitement ou congé à temps partiel/Authorized leave without salary or part-time leave

The current collective agreement provides that a regular full-time employee who has completed at least one year of service can ask for a leave of absence without salary of a maximum of one year for personal reasons or for education. It is granted at the employer’s discretion. An employee with at least five years of service is entitled to a leave of absence without salary for personal reasons, for a maximum of one year, which can be renewed for a maximum of three years. The convention provides that a maximum of two employees per campus can simultaneously be on such leave. Given this limitation, a request for renewal submitted by an employee may be refused.

Do you wish to increase the number of employees per campus who may be granted a leave of absence without salary?
Do you wish to eliminate the limit on the number of authorized leaves of absence without salary for the same employee?

The work year varies according to the employment category. As a general rule, the work year runs from July 1 to June 30. This period constitutes a full year and encompasses all leave periods provided for under the collective agreement, including an annual vacation based on seniority, statutory holidays, and any other periods of closure or reduced activity for support staff identified in the school calendar. The special education technicians, the adaptative material technician and the auxiliary nurses are nonetheless exempted, as their work year corresponds to that of teachers and consists of 200 days, as established by the school calendar. Finally, the attendants to handicapped students generally work during the 180 days when students are in attendance, to which five professional development days are added, resulting in a work year of approximately 185 days.

Considering these explanations, you consider that the length of your work year is appropriate.

Semaine de travail/Work Week

The work week also depends on the employment category of each support staff member. The general rule is a work week of 35 hours, which applies, among others, to secretaries, special education technicians and adaptative material technicians. The attendants to handicapped students are an exception: their work week is decided by the workload that is attributed to them. They are considered full-time employees as long as they work 25 hours or more per week. Typically, the work week does not exceed these 25 hours. The auxiliary nurses also enjoy a special arrangement, as their regular work week lasts 32,5 hours, distributed in five days.

Considering these explanations, you consider that the length of your work week is appropriate.

Temps plein – préposées et préposés aux élèves handicapés (PEH)/Full-time – attendants to handicapped students

Do you want to increase the number of hours allocated to the work week of an attendant?
Do you think that planning a workload for the substitute attendants (float team) is a good idea?

In the current agreement, the supernumerary employees do not accrue seniority. This situation affects especially the attendants to handicapped students, who often hold supernumerary employment before holding a regular position, acting, among others, as personal attendants. In practical terms, the years worked as a supernumerary employee are not taken into account for the choice of the workload or for the benefits associated with seniority, which might adversely affect employees otherwise experimented and well integrated into school.

Do you think that we should allow all supernumerary employees to accrue seniority in recognition of the importance of their work?

Subject to correction, the School considers that the following rules apply when an attendant replace a teacher : the attendants to handicapped students on call are to be paid according to the rate applicable to the substitute teachers not legally qualified, when other rules would apply to the attendants already appointed to a class. For example, after ten days of substituting, the attendant would receive a $12-per-day premium, retroactive to the first day of the assignment. This way of reading the provisions creates a distinct mode of compensation for the same employment category (attendants for handicapped students).

Taken into account this explanation, when an attendant to handicapped students substitutes in lieu of a teacher, should they be compensated as a substitute not legally qualified on their first day to avoid any ambiguity related to the mode of compensation?

Unlike most employees, the attendants to handicapped students do not enjoy sick leave credits, paid vacations or paid statutory holidays. In return, the collective agreement provides for a premium on their hourly rate (18,5%, 19,5% or 20,5%, depending on seniority). This premium is intended to financially compensate for the value of those benefits. It is therefore a different choice of compensation: a part of the benefits is paid directly as salary instead of being awarded as paid leaves. During our discussions with the School, the School provided credible evidence that the salary increase currently contemplated is at least as advantageous as, and potentially more advantageous than, access to the full range of employee benefits.
